Terms of Service

1. Eligibility & Account

You must be at least 18 years old (or the age of majority in your jurisdiction) and capable of entering into a binding contract to use Eyondo. You agree to provide accurate information during sign-up and to keep your account credentials confidential. You are responsible for all activity that occurs under your account.

2. The Service

Eyondo lets you generate images and short-form videos — including advertisements, product shots, avatars, and other creative assets — using AI models. You provide a prompt and optional references (avatar, product, app, or uploaded images); we orchestrate the necessary model calls and infrastructure to produce the result. The specific models, providers, and pipeline configuration we use internally may change without notice and form part of our proprietary technology.

We may modify, suspend, or discontinue any feature at any time. Beta features may be unstable; use them at your own risk.

3. Acceptable Use

You agree NOT to use the Service to create, request, attempt to generate, or distribute:

• Sexual, pornographic, sexually-suggestive, or nude content of any kind, whether involving real or AI-generated subjects.
• Sexual content involving minors, non-consensual intimate imagery, or any content that exploits or endangers real individuals.
• Unlawful, fraudulent, threatening, harassing, defamatory, or violent content.
• Content that infringes trademarks, copyrights, rights of publicity, likeness rights, or other intellectual property without authorization.
• Deepfakes or impersonation of real people (public figures, employees, customers, or anyone else) without their explicit, documented consent.
• Content that promotes self-harm, hate speech, terrorism, extremism, or discrimination on the basis of race, ethnicity, religion, gender, sexual orientation, disability, or nationality.
• Malware, phishing, scams, or any payload intended to harm systems or users.
• Commercial impersonation of brands, products, or public figures without authorization.
• Content that violates any applicable law in your jurisdiction or in any jurisdiction where the content is created, accessed, or distributed.

You also agree NOT to attempt to bypass, jailbreak, prompt-inject, or otherwise circumvent any safety filter, content moderation system, or rate limit. Coded language, layered or chained prompts, adversarial reference images, multi-step techniques, and third-party tooling intended to coerce prohibited outputs are all considered violations of these Terms — whether or not the attempt succeeds.

4. Safety Filters, Enforcement & Forfeiture

The Service includes content-safety filters intended to refuse prohibited requests. These filters operate on a best-effort basis and are not guaranteed to be perfect. AI models are probabilistic and may, despite our safeguards, occasionally produce outputs that are inaccurate, biased, offensive, or that resemble protected works or real persons.

Eyondo is NOT responsible for the content of any output you generate, view, download, or distribute through the Service. You — the user — bear sole and full responsibility for the legality, accuracy, ethics, clearance of third-party rights, and downstream use of every output, including any output produced through filter bypass, prompt injection, or any other unintended behaviour of our models.

If we detect, or have reasonable grounds to suspect, that you have generated, attempted to generate, requested, or distributed content that violates Section 3 — including (without limitation) sexual or pornographic content, content depicting minors, non-consensual intimate imagery, content infringing third-party intellectual property, deepfakes of identifiable real persons without consent, hate speech, content promoting violence or self-harm, terrorism content, or commercial impersonation — we may, at our sole discretion and without prior notice:

• Immediately suspend or permanently terminate your account.
• Delete the offending content and all related generations from our systems.
• Forfeit, with NO refund, any remaining credit balance, paid subscription period, and one-time credit-pack purchases on your account. You expressly waive any right to refund, chargeback, or compensation for forfeited balances arising from a violation under this Section 4.
• Retain logs and metadata related to the violation for legal, regulatory, and forensic purposes.
• Report the activity to law-enforcement, regulatory authorities, affected third parties (such as the impersonated individual or rights-holder), or platform partners where required by law or where we judge it appropriate.
• Pursue any other legal remedy available to us or to harmed third parties.

Forfeiture of paid balances under this Section is not a penalty but reasonable liquidated damages reflecting the resources required to investigate violations, the reputational risk to the Service, and the costs imposed on us by abuse. Initiating a chargeback or payment dispute related to a forfeiture under this Section is itself a material breach of these Terms.

5. Subscriptions, Plans & Credits

Eyondo offers free and paid tiers (Free, Lite, Starter, Creator, Studio). Paid plans include a recurring monthly grant of credits consumed per generation. Specific pricing, included credits, and features are listed on the Subscription page and may change with reasonable notice.

• Credits granted by a subscription are valid only while the subscription is active and reset each billing period.
• One-time credit packs purchased separately are valid for 90 days from the date of purchase. Any unspent pack credits lapse at the end of that window and are not refundable.
• Generations debit credits before model calls run; failed generations are refunded automatically.
• Free tier limits (40 signup credits, 2 lifetime free avatar generations) are per-account and cannot be reset by deleting and recreating accounts.

6. Payments & Refunds

Payments are collected by our payment processor, acting as Merchant of Record on our behalf. By subscribing, you authorize recurring charges to your selected payment method until you cancel. You can cancel any time from the Subscription page; cancellation takes effect at the end of the current billing period.

Except where required by law, all purchases are final and non-refundable. We do not provide refunds for partial billing periods, unused credits granted by a plan, or one-time credit-pack purchases. Because Outputs are produced by probabilistic AI models, dissatisfaction with the quality, style, accuracy, or content of a generated Output is not a defect in the Service and is not grounds for a refund or chargeback. 7. Your Content

You retain ownership of the prompts you submit and the images you upload ("Inputs"). By submitting Inputs, you grant Eyondo a non-exclusive, worldwide, royalty-free license to host, process, and pass them to the AI models we use, solely to operate the Service for you.

You represent and warrant that you own (or have rights to) all Inputs you provide and that your use of the Service does not violate the rights of any third party.

8. Generated Content

Subject to your compliance with these Terms, you own the videos and images you generate ("Outputs") and may use them commercially. Eyondo retains no ownership over your Outputs.

AI-generated content is produced by probabilistic models and may include similarities to other content the underlying models were trained on, or unintended likenesses to real persons, brands, or protected works. You are solely responsible for reviewing every Output before any use and for clearing any third-party rights (likeness, trademark, copyright, rights of publicity, sensitive cultural or religious imagery) before publishing or commercialising it. The presence or absence of a person, brand, location, or symbol in an Output does NOT warrant that it is cleared for commercial use, lawful in your jurisdiction, or fit for any particular purpose.

Eyondo expressly disclaims liability for any claim, damage, fine, takedown, or harm arising from your use, distribution, or commercialisation of any Output, regardless of whether the Output was produced through normal use, filter bypass, prompt injection, model error, or any other cause.

9. Intellectual Property

Eyondo, the website, the application code, design, and trademarks are owned by us or our licensors. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Service for its intended purpose. You may not copy, modify, reverse-engineer, or resell any part of the Service.

10. Third-Party Services

The Service is built on top of third-party AI model providers, cloud infrastructure, payment processors, and other vendors that we engage under written agreements. The specific identities and configuration of these providers are our confidential business information. Where their terms apply to your use of features they power (for example, payment processor terms at checkout), you will be presented with those terms at the relevant point in the flow. Our use of subprocessors is governed by our Privacy Policy.

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated Outputs will meet your expectations or be free of bias, inaccuracy, or objectionable content.

12. Limitation of Liability

To the maximum extent permitted by law, Eyondo will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or related to your use of the Service. Our total aggregate liability for any claim arising out of these Terms is limited to the greater of (a) the amount you paid to us in the 12 months preceding the event giving rise to the claim, or (b) USD 100.

13. Indemnification

You agree to indemnify, defend, and hold harmless Eyondo, its officers, employees, and contractors from any claim, demand, loss, damage, fine, regulatory action, or legal cost (including reasonable attorneys' fees) arising from (a) your Inputs or Outputs, (b) your violation of these Terms — including any attempt to bypass safety filters, (c) your violation of any third-party right, or (d) any content you publish, share, or commercialise that originated from the Service.

14. Termination

You may delete your account at any time from settings. We may suspend or terminate your access immediately if you violate these Terms, abuse the Service, or for any other reason at our reasonable discretion. Upon termination your right to use the Service ends; sections that by their nature should survive (ownership, disclaimers, liability, indemnification, governing law) will continue.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or via the Service before they take effect. Continued use after the effective date constitutes acceptance.

16. Governing Law & Disputes

These Terms and any dispute arising out of or relating to them or the Service will be governed by the laws applicable in your jurisdiction of residence, without regard to conflict-of-law principles. Any legal proceedings will be brought exclusively in the competent courts of your jurisdiction, unless mandatory consumer-protection laws provide otherwise.
